Ms. Birnbaum was unable to open a campground on her property in the foothills of Mt. Rainier while she waited over five years for Pierce County to issue a decision on her permit application. By law, the county should have issued a decision in 120 days.
When Ms. Birnbaum sued to recover damages she incurred as a result of the county’s unlawful delay, the court ruled that she had no right to recover. PLF attorneys have petitioned the Supreme Court of Washington to review Wendy’s case.
